Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and the independent developer of FoldMan ("FoldMan," "we," "us," or "our"). They govern your use of FoldMan's website and online features, including Remote Play (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Your license to the iOS app is governed by Apple'sStandard Licensed Application End User License Agreement (the "Apple Standard EULA"), not by a custom end-user license agreement. These Terms add rules for FoldMan's Services and user conduct. If these Terms conflict with the Apple Standard EULA about your app license, the Apple Standard EULA controls.
Who may use FoldMan
You must be legally able to agree to these Terms. If you are below the age at which you can agree for yourself where you live, a parent or legal guardian must approve your use and is responsible for it. Children should use Remote Play only with a parent or guardian's involvement and with people they know.
What the service does
FoldMan is a collaborative drawing game. Local games run on one device. Remote Play uses Apple iCloud and CloudKit to let invited players take turns on separate devices. FoldMan does not provide its own user account. An Apple Account with iCloud enabled and a network connection are required for Remote Play, syncing, and some purchase functions.
We may improve, add, remove, suspend, or discontinue features. We will try to avoid disrupting games, but we do not promise that the Services, any particular feature, or compatibility with every device or operating-system version will always be available.
Your content
"Your Content" means drawings, creature names, player names, profile images, and other material you choose to create or provide in FoldMan. You keep any rights you have in Your Content. You are responsible for Your Content and for having the rights and permissions needed to use and share it.
You give us a limited, non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, and display Your Content only as reasonably needed to operate, secure, and support FoldMan, comply with law, and respond to reports. This license ends when the relevant content is deleted from the Services, except for copies that other players have kept, normal backups, reports, and records we must retain for safety or legal reasons.
Remote Play deliberately shares content with the people in your game. They can see your chosen profile, receive your drawings, save the finished creature, or share it outside FoldMan. Invite only people you trust, do not put sensitive personal information in a game, and do not assume another participant will delete their copy.
Acceptable use
You may not use FoldMan or help someone else use it to:
- harass, threaten, bully, stalk, exploit, or impersonate another person;
- create or share content that is unlawful, hateful, sexually exploitative, deliberately abusive, or that promotes serious violence or self-harm;
- sexualize or exploit a child, or request personal information from a child;
- infringe copyright, privacy, publicity, trademark, or any other person's rights;
- share another person's private information without permission;
- interfere with FoldMan, iCloud, another player's device or game, or any security or access control;
- introduce malicious code, automate abusive traffic, or attempt unauthorized access;
- use the Services for unlawful commercial spam, fraud, or any illegal purpose.
Invitations, reporting, and blocking
Invitation links and codes are meant for the players you choose. Do not publish an active code unless you are willing for anyone who sees it to request access to that game. Invitations expire, and a game has limited seats, but those controls do not make a publicly posted code private.
FoldMan does not proactively monitor private games. If another player behaves badly, use the in-app report action. A report sends the selected reason and identifiers needed to understand the incident for developer review; it does not automatically send the drawing. Reporting also adds that participant to your private block list so they cannot join your games again from the same iCloud identity. You may also leave or dismiss a game.
We may take any action reasonably available to protect users or the Services, including preserving evidence, restricting access, or referring a matter to the appropriate authorities. Because FoldMan has no standalone account system, the actions technically available to us may be limited.
In-app purchases and payments
FoldMan's in-app purchases are offered as one-time, non-consumable purchases. They are not recurring subscriptions. The price and included features shown on the App Store purchase screen at the time of purchase are the offer that applies to you.
Apple processes the transaction, taxes, refunds, and restoration through your Apple Account. RevenueCat helps FoldMan verify the purchase and unlock the entitlement. We do not receive your full payment-card details. Purchases are also subject to Apple's applicable App Store and media-services terms. Refund requests must be directed to Apple, except where applicable law requires otherwise.
A purchase does not guarantee that network-dependent features will operate without interruption or that third-party services such as iCloud will remain available forever. If a purchased feature fails to conform to an applicable warranty, the rights and remedies in the Apple Standard EULA and your mandatory consumer laws apply.
Apple and other services
FoldMan relies on Apple services including the App Store, iCloud, CloudKit, system photo picker, and push notifications, and on RevenueCat for purchase entitlements. Your use of those services is subject to their terms. We are not responsible for third-party services, outages, account restrictions, storage limits, or changes that are outside our control.
Apple is not a party to these Terms and is not responsible for FoldMan's online Services. Nothing here changes Apple's obligations or your rights under the Apple Standard EULA or applicable law.
FoldMan's rights
FoldMan, its visual design, software, website, text, and other materials supplied by us are protected by intellectual-property laws. Except for the rights granted by the Apple Standard EULA, we do not grant you rights in those materials. You may not use FoldMan's name, branding, or assets in a way that suggests endorsement or ownership.
Suspension and ending use
You may stop using FoldMan at any time. You can leave remote games, delete local gallery items, and remove the app. Removing the app does not necessarily delete iCloud records, copies held by other players, or App Store purchase records.
We may suspend or restrict access to Services where reasonably necessary to address a serious violation of these Terms, protect users or the Services, comply with law, or respond to circumstances outside our control. The app license may also terminate as described in the Apple Standard EULA.
Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available." We do not promise that they will be uninterrupted, error-free, secure, or that a drawing or remote game will never be lost. You are responsible for keeping copies of content that matters to you and for using Remote Play with appropriate people.
Nothing in these Terms excludes any warranty, guarantee, remedy, or other consumer right that cannot lawfully be excluded. The Apple Standard EULA contains additional warranty terms for the licensed app.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or opportunities, arising from the Services. Our total liability relating to the Services will not exceed the greater of the amount you paid for FoldMan during the twelve months before the event giving rise to the claim or US $50.
These limitations do not apply where prohibited by law, including to liability that cannot be limited for fraud, wilful misconduct, personal injury, or mandatory consumer rights. The Apple Standard EULA may provide additional terms relating to liability for the licensed app.
Changes to these terms
We may update these Terms when the Services or applicable law change. The date at the top identifies the current version. If a change materially affects your rights, we will provide notice through the app or website when appropriate. Changes apply prospectively; continuing to use the Services after they take effect means you accept the updated Terms.
General terms
If a court finds part of these Terms unenforceable, the rest remains in effect. A failure to enforce a term is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, sale, or transfer of FoldMan, subject to applicable law. These Terms, the Privacy Policy, and the Apple Standard EULA are the entire agreement about the subjects they cover.
These Terms do not choose a law or court that overrides the mandatory rights of the country or region where you live.
